1. Acceptance of Terms

By accessing or using services provided through cubeminerhost.com ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use our services. These Terms constitute a legally binding agreement between you ("Customer," "you," or "your") and CubeMinerHost ("we," "us," or "our").

We reserve the right to modify these Terms at any time. Continued use of our services after changes are posted constitutes acceptance of the modified Terms. Material changes will be communicated via email to the address associated with your account at least thirty (30) days before they take effect.

These Terms apply to all users of the CubeMinerHost platform, including visitors browsing our website, registered account holders, and paying customers using our game server hosting services. If you are accepting on behalf of a gaming community, organization, or other entity, you represent that you have authority to bind that entity.

2. Service Description

CubeMinerHost provides game server hosting, including but not limited to Minecraft (Java & Bedrock editions), Valheim, Terraria, Rust, ARK: Survival Evolved, Palworld, and other supported titles. Our platform includes modpack management, one-click mod installation, automated backups, DDoS protection, custom JAR support, and related infrastructure services.

Service specifications — including compute resources (CPU cores, RAM allocation), storage (SSD/NVMe), player slots, and available features — are described on our website and within the control panel. These specifications represent the resources dedicated to your game server and are subject to the limits of your selected plan.

We may update, modify, or discontinue specific features, supported game titles, or server versions with reasonable notice. CubeMinerHost does not guarantee compatibility with all game modifications, plugins, modpacks, or custom configurations. It is your responsibility to verify that your desired game setup is compatible with the resources and server version you select.

Server performance may vary depending on the complexity of installed mods, number of active players, world size, and other workload-specific factors. CubeMinerHost is not responsible for performance degradation caused by resource-intensive modifications or configurations.

3. Account Registration & Security

You must provide accurate, current, and complete information during registration and maintain the accuracy of such information throughout the duration of your account. You are responsible for maintaining the confidentiality of your account credentials, including passwords, API keys, and FTP/SFTP credentials.

You are solely responsible for all activities that occur under your account, whether by you, members of your gaming community, or any third party. You must notify CubeMinerHost immediately of any unauthorized use of your account or any other security breach.

We strongly recommend enabling two-factor authentication (2FA) for added security. Accounts may not be shared with, sold to, or transferred to another party without prior written consent from CubeMinerHost. We reserve the right to suspend accounts we reasonably believe have been compromised to protect your data and server configurations.

You must be at least thirteen (13) years of age to create an account; users under eighteen (18) must have parental or guardian consent.

4. Acceptable Use Policy

You agree not to use CubeMinerHost services for any unlawful purpose or in violation of applicable laws and regulations. Prohibited activities include but are not limited to:

  • Distributing or hosting illegal content, malware, ransomware, or phishing materials
  • Using game servers to facilitate harassment, threats, doxing, swatting, or abuse of players
  • Engaging in resource abuse, including cryptocurrency mining or running non-game workloads
  • Attempting unauthorized access to other users' accounts, servers, or networks
  • Conducting denial-of-service attacks or network scanning of third parties
  • Violating intellectual property rights of third parties or game publishers
  • Distributing game cheats, exploits, pirated software, or hacked clients via our servers
  • Running non-game workloads (websites, databases, bots) on game server plans without authorization
  • Deliberately crashing or destabilizing shared infrastructure through plugin or mod abuse
  • Hosting content that promotes violence, hatred, discrimination, or child exploitation

Violation of this policy may result in immediate suspension or termination of services without prior notice or refund. We reserve the right to remove or disable any content that violates this policy. Repeated or severe violations will result in permanent account termination and forfeiture of remaining service credits. We may report suspected illegal activities to appropriate authorities.

5. Service Level Agreement

CubeMinerHost guarantees 99.9% network and infrastructure uptime, measured on a monthly basis. Uptime percentage is calculated as: ((total minutes in month − downtime minutes) / total minutes in month) × 100. Uptime is calculated excluding scheduled maintenance windows, which are communicated at least 48 hours in advance.

In the event that uptime falls below the guaranteed threshold, eligible customers may request service credits. Credit requests must be submitted within thirty (30) days of the incident via our support system.

Credit tiers: for monthly uptime between 99.5% and 99.9%, a credit of 10% of monthly fees; between 99.0% and 99.5%, a credit of 25%; below 99.0%, a credit of 50%. Maximum credit is 50% of the monthly fee for the affected service. Credits are applied as account balance and are not refundable as cash or transferable.

This SLA does not apply to disruptions caused by: (a) force majeure events; (b) customer-initiated actions such as installing unstable mods, misconfiguring server settings, or exceeding plan limits; (c) third-party service failures; (d) scheduled maintenance; or (e) DDoS attacks exceeding our mitigation capacity.

6. Payment Terms & Billing

Services are invoiced on a monthly billing cycle. Payment is due within fourteen (14) days of the invoice date. All prices are listed in United States Dollars (USD) and are exclusive of applicable taxes, duties, and levies unless otherwise specified.

Failure to make timely payment may result in suspension of services. CubeMinerHost reserves the right to charge interest on overdue amounts at a rate of 1.5% per month, or the maximum rate permitted by law, whichever is lower. Services suspended due to non-payment may be terminated and data deleted after thirty (30) days of continued non-payment.

Services renew automatically unless cancelled before the next billing cycle. Price changes are communicated at least thirty (30) days in advance and take effect at the start of the next cycle. Prorated refunds are available for unused time on cancelled services. You are responsible for all applicable taxes and duties associated with your use of the services.

7. Data Protection & GDPR Compliance

CubeMinerHost is committed to compliance with the General Data Protection Regulation (GDPR), the Dutch Implementation Act (UAVG), and applicable data protection legislation. All customer data is stored in European data centers within the EEA with enterprise-grade security measures in place.

Data is encrypted both at rest (AES-256) and in transit (TLS 1.3). We maintain strict access controls based on the principle of least privilege and conduct regular security audits.

As a data processor, CubeMinerHost processes personal data only as instructed by you, the data controller. We do not sell, share, or use your data for advertising. A Data Processing Agreement (DPA) is available on request. Data breach notifications are issued within seventy-two (72) hours per GDPR requirements. You may exercise your data rights — access, rectification, erasure, portability — at any time through our support team.

Game server data (world files, player data, configurations) is included in our automated backup system. Backups are retained according to your plan's backup retention policy. You are encouraged to maintain additional independent backups of critical world data.

8. Intellectual Property

All content, trademarks, logos, software, and documentation provided by CubeMinerHost — including the control panel, server management tools, website, and APIs — are the exclusive property of CubeMinerHost or its licensors and are protected by applicable intellectual property laws.

You retain full ownership of your game server data, including world files, player databases, server configurations, resource packs, and any custom content you create or upload. You grant CubeMinerHost a limited, non-exclusive license to host and process your content solely for the purpose of providing the contracted services. This license automatically terminates when your account is closed.

Game titles, logos, character designs, and related assets (e.g., Minecraft, Mojang, Microsoft) belong to their respective publishers and rights holders. CubeMinerHost's hosting services do not imply endorsement by, affiliation with, or licensing from any game publisher. You are responsible for ensuring your use of game content complies with the applicable End User License Agreement (EULA) of each game.

You may not copy, modify, reverse-engineer, decompile, or create derivative works from any part of the CubeMinerHost platform or its proprietary software.

9. Limitation of Liability

To the maximum extent permitted by applicable law, CubeMinerHost's total aggregate liability for any claims arising out of or related to these Terms or the services shall not exceed the total fees paid by you during the twelve (12) months immediately preceding the event giving rise to the claim.

In no event shall CubeMinerHost be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, game progress, world saves, player statistics, in-game items, or business opportunities, regardless of the theory of liability.

CubeMinerHost is not liable for failures caused by force majeure, third-party disruptions, mod or plugin conflicts, game updates that break compatibility, or actions you or your players take on your servers. We strongly recommend maintaining regular independent backups of your world data and server configurations. This limitation applies to the fullest extent permitted by the laws of the Netherlands.

10. Indemnification

You agree to indemnify, defend, and hold harmless CubeMinerHost, its officers, employees, agents, and affiliates from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:

  • Your use of CubeMinerHost services or activity under your account
  • Your violation of these Terms or any applicable law or regulation
  • Infringement of third-party or game publisher intellectual property rights through your server content
  • Content you host, distribute, or make available through your game servers, including mods, plugins, and resource packs
  • Actions, conduct, or disputes involving players on your hosted servers
  • Violation of any game publisher's EULA or terms of service

This indemnification obligation survives the termination or expiration of these Terms and your use of CubeMinerHost services.

11. Termination & Cancellation

Either party may terminate this agreement by providing thirty (30) days' written notice. You may cancel your services at any time through the control panel. CubeMinerHost reserves the right to terminate services immediately, without prior notice or refund, in the event of a material breach of these Terms.

Upon termination, you are responsible for downloading your server data (world files, configurations, plugins) prior to the effective termination date. CubeMinerHost provides download tools in the control panel to facilitate data export. We will retain your data for thirty (30) days following termination, after which all data — including backups — will be permanently deleted.

Outstanding invoices remain due after termination. Prorated refunds are issued for unused time in the current billing period. Provisions that by their nature should survive — including liability, indemnification, and intellectual property — continue in effect after termination.

12. Dispute Resolution

In the event of a dispute, the parties shall first attempt to resolve the matter through good-faith negotiation. Either party may initiate negotiation by sending a written notice describing the dispute and the relief sought.

If the dispute is not resolved within thirty (30) days, either party may escalate to mediation administered by a mutually agreed mediator in the Netherlands. Mediation costs are shared equally. Each party bears its own legal costs.

If mediation fails within sixty (60) days, either party may pursue formal proceedings in the competent courts of the Netherlands. Nothing in this section prevents either party from seeking injunctive relief at any time.

13. Modifications to Terms

CubeMinerHost reserves the right to update these Terms of Service at any time. Changes are posted on this page with an updated "Last updated" date. For material changes that affect your rights, we provide at least thirty (30) days' advance notice via email.

Continued use of our services after modifications become effective constitutes acceptance. If you disagree, discontinue use before changes take effect and you may cancel for a prorated refund. Non-material changes (typo corrections, clarifications) may be made without advance notice. The most current version is always available on our website.

14. Governing Law & Jurisdiction

These Terms of Service shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions. The United Nations Convention on Contracts for the International Sale of Goods (CISG) does not apply.

Any disputes shall be submitted to the exclusive jurisdiction of the competent courts in the Netherlands. If any provision of these Terms is found unenforceable, it shall be enforced to the maximum extent permissible, and the remaining provisions continue in full force. Our failure to enforce a right does not waive it. These Terms, together with our Privacy Policy, constitute the entire agreement between you and CubeMinerHost.
